Good news for Taxpayers !!!Now GST System will auto calculate ITC to be reversed on account of non filing of GSTR-3B by supplier as per Rule 37A.Also same will be communicated to concerned Taxpayers via registered mail ID.This is really a good move, otherwise as a taxpayers need to identify such ITC manually which is a big task to do.

Section 16(2)(c)- Initially most of the taxpayers and even consultants took it lightly.Various judgements suggest that payment by the seller is vital for eligible claim of input tax credit by the buyer.Even if the purchase is genuine and the payment is made via bank. There is almost negligible hope of respite on this issue. But there are still some arguments thats still need the attention of courts.- Govt can put a condition on benefits but can they put a condition which is impossible for a buyer to comply.- ITC is vital feature of GST. In some instances where the return is filled too late by seller in some amnesty scheme, the tax is paid by the seller but ITC is not available to the buyer. This creates an unjust enrichment for the government.- Does the government have any mechanism where the tax , if recovered by the govt from the seller at any stage after the reversal by the buyer, the ITC should be given back.Pls add your points.
